Background of the Study

Gender-sensitive budgeting (GSB) is a crucial tool for ensuring that government policies and budgets address the unique needs of men and women, particularly in marginalized regions like Damaturu Local Government Area (LGA). While the Nigerian Constitution provides for equality between genders, the allocation of resources often fails to reflect the specific needs of women in Damaturu LGA, exacerbating issues like gender inequality and economic marginalization. Constitutional law plays a pivotal role in ensuring that gender equality is reflected in national and local government budgets, particularly by mandating that budgetary allocations be gender-sensitive.

This study will examine how constitutional law influences gender-sensitive budgeting in Damaturu LGA, with a focus on assessing the implementation and challenges of gender-inclusive budgeting practices at the local government level. The study will explore the extent to which constitutional provisions on gender equality are reflected in local budgets and policy initiatives.

1.2 Statement of the Problem

Despite constitutional guarantees of gender equality, Damaturu LGA continues to experience budgetary neglect of gender-specific needs. This results in gender disparities in education, healthcare, and economic empowerment for women. The research aims to identify the legal barriers to effective gender-sensitive budgeting and propose ways to enhance the implementation of constitutional law to promote gender equality in Damaturu LGA.

1.3 Objectives of the Study

  1. To assess how constitutional law influences the implementation of gender-sensitive budgeting in Damaturu LGA.

  2. To identify the challenges in implementing gender-sensitive budgets at the local government level in Damaturu LGA.

  3. To propose policy recommendations for improving gender-sensitive budgeting through constitutional law in Damaturu LGA.

1.4 Research Questions

  1. How does constitutional law impact gender-sensitive budgeting in Damaturu LGA?

  2. What are the barriers to effective gender-sensitive budgeting at the local government level in Damaturu LGA?

  3. What policy reforms are needed to improve the gender equality focus in Damaturu’s local budgets?

1.5 Research Hypotheses

  1. Constitutional law provides an adequate framework for gender-sensitive budgeting, but the lack of political will hinders its implementation in Damaturu LGA.

  2. Gender inequality in Damaturu LGA persists due to insufficient allocation of resources for women-focused projects.

  3. Strengthening gender-sensitive budget policies and ensuring constitutional compliance will reduce gender disparities in Damaturu LGA.

1.6 Significance of the Study

This research will contribute to the promotion of gender equality in Nigeria, with particular focus on how constitutional law can ensure gender-sensitive budgeting at the local government level. The study will provide policy insights for government agencies and civil society on how to integrate gender into financial policies and public spending.

1.7 Scope and Limitations of the Study

This study will be focused on Damaturu LGA, Yobe State, and will examine the implementation of gender-sensitive budgets at the local government level. Limitations include potential difficulty in accessing financial data and lack of clear documentation on gender-specific budget allocations.

1.8 Operational Definition of Terms

  1. Gender-Sensitive Budgeting (GSB): A budgeting approach that integrates gender analysis to ensure equitable allocation of resources based on the needs of men and women.

  2. Constitutional Law: The Nigerian Constitution provisions that mandate gender equality and equitable treatment in policy and budgeting.

  3. Gender Equality: The state in which men and women have equal rights, opportunities, and resources.
